Grounds for divorce - are they different for same sex couples?

John Leadbeater, a divorce lawyer in Bedford, explains the difference for same sex/gay couples when it comes to the grounds or reasons for divorce

"For the most part, the grounds for divorce in same sex marriages are the same, but a same sex marriage cannot rely on adultery because the definition of adultery is ‘engaging in sexual intercourse with a person of the opposite sex’.

Therefore if a gay couple separated because one of them went off with a member of the same sex, they could not rely on adultery – it would have to be ‘unreasonable behaviour’."
