When drafting contracts with consumers, it is important to know that the law will imply certain terms into some contracts and will prohibit the inclusion of other (unfair) terms. Generally, a consumer is a person who is not dealing in the course of their business, although some legislation includes more specific definitions and conditions.
The relevant Acts and Regulations are:
• Unfair Contract Terms Act 1977
• The Sale of Goods Act 1979
• The Supply of Goods and Services Act 1982
• Consumer Protection Act 1987
• Unfair Terms in Consumer Contracts Regulations 1994.
